7. Payment & Refund Policy
Payment Terms
Unless otherwise stated, full payment is required at the time of purchase confirmation. Access to digital products and services will be granted only after full payment is received.
Refunds and Cancellations
Due to the digital nature of our products, refunds or cancellations are generally not offered once a purchase has been made. Refunds or credits may be issued at our sole discretion under exceptional circumstances. Customers are advised to thoroughly review their selections before purchasing.
8. Domain Name Management
Important: We have strict policies due to the nature and complications involved with Domain Name management, but if clients communicate issues clearly, we have always been very flexible with difficult challenges.
Payment and Late Fees
- Non-Payment: If payment for domain name services is not received by the due date, a late fee of $50/month will be imposed until the balance is paid
- Settlement Period: Clients must settle outstanding balances within 2 weeks to avoid further actions
Recovery and Redemption
- Recovery Fee: If a domain remains unpaid for 3+ months and the client wishes to reclaim it after service suspension, a recovery fee of $50/month will be applied
- Transfer Advisory: Clients are advised to transfer their domain names prior to service termination if they wish to manage them independently
- Redemption Period: After service termination due to non-payment, domains enter a 30-day redemption period as dictated by registrar policies
- Domain Ownership: If domains are not reclaimed or fees settled within the redemption period, Apex Web Services reserves the right to take ownership to recover unpaid fees
9. Service Termination
Grounds for Termination
Non-Payment
If payment for services is not received by the due date, Apex Web Services reserves the right to suspend or terminate access to provided services. Clients will receive notification and must settle outstanding balances within 2 weeks (unless other terms are agreed upon in writing) to avoid termination.
Abuse of Staff
Apex Web Services is committed to maintaining a respectful, safe environment for our staff. If a client engages in behavior that is abusive, threatening, or harassing towards our staff, we reserve the right to suspend or terminate their services immediately. No refunds of any sort will be dispersed in this type of scenario.
Illegal Activities
Engaging in illegal activities directly or indirectly related to the services provided by Apex Web Services will result in immediate suspension or termination. This includes, but is not limited to, hosting illegal content, using services for unlawful purposes, or purposely violating intellectual property laws.
Post-Termination Responsibilities
At the termination of services, Apex Web Services is immediately free of any responsibility associated with the access provided. Clients are required to withdraw the developer access granted to us promptly to maintain the security of their systems.
10. Limitation of Liability
Recording and Transcription Notice
Notice of Recording: All client meetings and communications conducted through our platforms are recorded for quality assurance purposes and to facilitate accurate transcription services.
Platform Use Restrictions
- Disclaimer of Liability: The Company expressly disclaims any and all liability, responsibility, or obligation arising from or related to the use of our platforms for confidential, privileged, or private communications. Users acknowledge and agree that they utilize our platforms at their own risk.
- Prohibited Use: Our platforms are not intended for, and users are expressly prohibited from conducting, confidential attorney-client communications, privileged discussions, or any other private conversations that may require legal protection or confidentiality.
Liability Limitations
TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY CLIENT IN THE 12 MONTHS PRECEDING THE CLAIM. This limitation applies to all claims, whether in contract, tort, or otherwise.
Apex Web Services will not be liable for any indirect, incidental, consequential, or special damages arising from the use or inability to use our digital products or services, even if we have been advised of the possibility of such damages.
Force Majeure
